These Terms and Conditions govern the use of the mobile application "SetupKart Pro" (hereinafter "App"), developed and operated by Hermann Kopp, Switzerland (hereinafter "Provider").
By downloading, installing or using the App, the user agrees to these Terms. If the user does not agree, the App must not be used.
SetupKart Pro is a mobile application for digital recording, management and analysis of kart setup data, including:
The App is available in German, English, French, Italian, Spanish and Dutch.
3.1 Trial: The App can be tested free of charge for 30 days. After the trial period, a paid subscription is required.
3.2 Monthly Subscription: CHF 4.99 per month. Renews automatically each month unless cancelled at least 24 hours before the end of the current period.
3.3 Annual Subscription: CHF 24.99 per year. Renews automatically each year unless cancelled at least 24 hours before the end of the current period.
3.4 Payment: Payment is processed exclusively through the Apple App Store or Google Play Store. Their respective terms apply. Subscriptions can be managed and cancelled in the store settings.
The Provider grants the user a simple, non-transferable right to use the App on one device for the duration of the license. Reverse engineering, modification and redistribution are prohibited.
Setup data is stored locally on the user's device by default. If the user activates optional cloud features, data may be stored on external servers. Details can be found in the Privacy Policy.
The user is responsible for backing up their data. The Provider assumes no liability for data loss.
The Provider is not liable for direct or indirect damages arising from the use of the App, particularly not for damage to the kart, accidents or performance losses. Liability for intent and gross negligence remains reserved.
No guarantee is given for uninterrupted and error-free functionality. The Provider reserves the right to update, modify or discontinue the App at any time.
All rights to the App remain with the Provider. The user acquires only the usage right described in Section 4.
The license expires automatically at the end of the license period. Early termination does not entitle to a refund.
The Provider reserves the right to change these Terms at any time. Continued use after changes constitutes acceptance.
Swiss law applies exclusively. Place of jurisdiction is the Provider's domicile in Switzerland.

The protection of your personal data is important to us. This privacy policy informs you about which data is collected when using the app «SetupKart Pro» and how it is used.

SetupKart Pro was developed following the «Privacy by Design» principle. All setup data you enter is stored locally on your device by default.
If the user activates future optional cloud features, data may be stored on external servers. In this case, the user will be informed in advance and the privacy policies of the respective cloud provider will also apply.
3.1 Setup data (local)
All technical data you enter in the app is stored exclusively on your device and is not transmitted to the provider.
3.2 GPS location (optional)
The app can optionally use your GPS location to automatically identify the race track. This data is processed locally only and not shared with third parties (except for the optional weather query, see 3.6).
3.3 Voice input (optional)
The voice input function uses your device's speech recognition. Processing is subject to your device manufacturer's privacy policy (Google/Android).
3.4 Device ID (for licensing)
A device ID is used to bind the activation code to your device. This is stored exclusively for licence management purposes.
3.5 Contact data (for purchase)
Your email address is used to deliver the activation code and is not shared with third parties.
3.6 Weather data (optional)
The app can optionally fetch current weather data via the Open-Meteo API. GPS coordinates (latitude, longitude) are transmitted to the service open-meteo.com. No personal data is transmitted. Open-Meteo is an open-source weather service that requires no registration. More information: open-meteo.com.
The function for exporting and sharing setup data (.kart files) is initiated by the user. The provider has no influence on who the user shares data with.
If you obtain the app via the Google Play Store, Google's privacy policy also applies. Google may collect usage data (e.g. downloads, crashes). The provider has no influence on this.
You have the right to information, correction, deletion, restriction of processing and data portability at any time. Contact: appstract7@gmail.com.
Local storage provides a high level of data security as no transmission over the internet takes place (except for the optional weather query).
Locally stored data remains on your device until you delete it or uninstall the app. Contact and licence data is stored in accordance with statutory retention periods.
The provider reserves the right to amend this privacy policy as needed. The current version is always available at setupkart.ch.
This privacy policy is governed by Swiss law (FADP). Where the EU GDPR applies, it is also taken into account.
